Default HELP! someone is selling my pics!

The attached link shows some pics I submitted to our local rag, they were published to promote the local nightlife. I submitted them with the hope & intention that they would indeed be published. I offered them free of charge & they were, I assume, quickly appreciated as a low / non cost inclusion to the publication.
Now, to my amazement, the cheeky blighters are selling them for £8.90 each!
Can they legally do this?
Do I have any legal route to stop them or indeed claim any of the moneys they may recieve from the sale of my photo's?

The footer on the website states "All images on this site are the copyright of CN/Furness Newspapers - North West Evening Mail".

If you did not agree to give up all of your rights to the images when you sent them, you still retain the copyright to your original work and their statement is not true nor should they be able to sell them without your permission.

I would contact them and find out what is going on...chances are that someone got them mixed up with shots from a staff or contract photographer, where they generally do have the rights to sell them like this.

Disclaimer: this is my own opinion and I am not a lawyer or expert in copyright law!

they do the "going out guide" section every thursday. they have an email adress to contact/send images. i have never been told that i am giving up the copyright for the images or they will be for sale.

Looks like time to check the fine prints on written policies.

It used to be that you could get a print of a photo in the paper by going to there offices and ordering one. Now it appears that they send the photos that they publish to some other company www.newsprints.co.uk for people to order prints. The ToS imply that they share the profits with the photographers.

It could be that they've just forwarded all the photos they print onto the printing company.

If I were you I'd query whether they have made a mistake, and how much you'll get from any sales.
